Abstract

In this book John Cook interacts with the range of approaches to the perennial questions on the Biblical Hebrew verb in a fair-minded approach. Some of his answers may appear deceptively traditional, such as his perfective-imperfective identification of the qatal-yiqtol opposition. However, his approach is distinguished from the traditional approaches by its modern linguistic foundation. One distinguishing sign is his employment of the phrase "aspect prominent" to describe the Biblical Hebrew verbal system. As with almost any of the world's verbal systems, this aspect-prominent system can express a wide range of aspectual, tensed, and modal meanings. In chap. 3, he argues that each of the forms can be semantically identified with a general meaning and that the expressions of specific aspectual, tensed, and modal meanings by each form are explicable with reference to its general meaning. After a decade of research and creative thinking, the author has come to frame his discussion not with the central question of "Tense or Aspect?" but with the question "What is the range of meaning for a given form, and what sort of contextual factors (syntagm, discourse, etc.) help us to understand this range in relation to a general meaning for the form?" In chap. 4 Cook addresses long-standing issues involving interaction between the semantics of verbal forms and their discourse pragmatic functions. He also proposes a theory of discourse modes for Biblical Hebrew. These discourse modes account for various temporal relationships that are found among successive clauses in Biblical Hebrew. Cook's work addresses old questions with a fresh approach that is sure to provoke dialogue and new research.

Abstract

The role of the European judiciary in the process of European integration cannot be overestimated. The achievements of European integration after the second world war are usually analyzed from the perspective of political decisions that were made, initially, by the Founding Fathers and, subsequently, by the political leaders of the European countries. However, in the public debate we very often forget how much we owe to the two supreme jurisdictions of Europe, that is the Court of Justice of the European Union and the European Court of Human Rights. The continuing extension of the competences of the European Union, especially in the field of economic and monetary policy, calls for a new assessment of the nature of the decision-making process at the European level. From the foreword by Prof. Maciej Szpunar, Advocate General at the Court of Justice of the European Union'The European judiciary - i.e. the Court of Justice of the European Union (CJEU), the European Court of Human Rights (ECtHR) and national courts interpreting and applying European law sensu largo - have shaped [the process of European integration] actively, alongside the Founding Fathers, European nations, European states and their citizens. The involvement of the judiciary raises its own wide range of questions concerning the very nature of democracy. Much ink has already been spilled over issues such as democratic legitimacy, subsidiarity and accountability, the rule of law or judicial activism.[...] seventeen scholars from across Europe [...] share their views on the European judiciary as a challenge for democracy. The various contributions to the present volume are split into two parts. The first provides ten chapters on the judicial systems of the European Union (EU), discussing, inter alia, recognition of democratic principles in the case law of the CJEU, contribution thereof to the democratisation of the Union and reception of EU law in the Member States. The second part discusses the judicial means to protect human rights in Europe, consisting of three chapters devoted to the promise of advisory opinions of the ECtHR as well as to democratic standards for voting and for fair trial. From the preface by the Editors'[...] the editors, authors and the publisher of this volume decided to take a closer look at the relation between democracy and activities of something that might be called "European judicial systems". And what is intriguing - these systems are perceived here as a challenge for democracy.[...] This book does not exhaust all problems and issues for European judicial systems confronted with the very notion of democracy; there are simply too many of them. But it comes with a fresh look on - perhaps - the most pertinent ones, like the issue of the legal creativity of judges in both Luxembourg and Strasbourg. It was worth waiting for this volume.'Prof. Dr. Paul De Hert, Free University Brussels and Tilburg University

Abstract

“Practitioners and scholars have stressed the risks posed by the weakening of political legitimacy of the EU vis à vis European citizens. These conclusions are mostly drawn on speculation. This fascinating comparative study uses mixed methods to empirically explore how and when does European opposition emerge. If criticism from European citizens and political parties remains unheard within the European elitist construct, such criticism will transform itself into rejection. With an innovative look at the academic scholarship on Euroscepticism this book fills major gaps and offers important suggestions for both policy makers and academics.” —Manuela Caiani, Professor, Scuola Normale Superiore, Florence, Italy Is Euroscepticism still suited to analyze the variegated nature of opposition to the EU? Starting with this question, this book critically reviews Euroscepticism, reconceptualizes it in terms of political opposition and discovers, disentangles and explains patterns of EU-opposition within the European Parliament (EP). Distinguishing between “what the EU does” and “what the EU is”, the research elaborates an index of parties’ positioning, “measuring” it through the speeches that parties’ deliver in the EP. The EP is the “perfect laboratory” where decisions concerning EU-policies are taken and the future EU-trajectories are shaped. Besides delineating a set of guidelines categorizing parties, the book concludes that their positioning varies along two main axes: the pro-anti-EU-system and the pro-anti-EU-establishment. From a normative perspective, the research argues for the growing importance of the “cumulation hypothesis”: if criticism remains unheard within the European elitist construct, such criticism will transform itself into rejection. Benedetta Carlotti holds a PhD in Political Science and Sociology from the Scuola Normale Superiore, Florence, Italy. She is currently a Data Analyst in a private company located in Florence where she deepens text analysis methods. Her main research interests concern positioning toward the EU with a special focus on extremist and populist parties. She has engaged in research collaboration with the University of Siena and with the Scuola Normale Superiore. Her work has been published in the Italian Political Science Review, European Political Science Review and Italian Political Science.

Abstract

In this groundbreaking, cross-disciplinary work of philosophy and biblical studies, New Testament scholar C. Kavin Rowe explores the promise and problems inherent in engaging rival philosophical claims to what is true. Juxtaposing the Roman Stoics Seneca, Epictetus, and Marcus Aurelius with the Christian saints Paul, Luke, and Justin Martyr, and incorporating the contemporary views of Jeffrey Stout, Alasdair McIntyre, Charles Taylor, Martha Nussbaum, Pierre Hadot, and others, the author suggests that in a world of religious pluralism there is negligible gain in sampling from separate belief systems. This thought-provoking volume reconceives the relationship between ancient philosophy and emergent Christianity as a rivalry between strong traditions of life and offers powerful arguments for the exclusive commitment to a community of belief and a particular form of philosophical life as the path to existential truth.

Abstract

International Human Rights Protection, addressed to judges and lawyers, diplomats and civil servants, researchers and students, is based on the author's personal research and personal involvement with a wide range of subjects, such as the basic concepts of civil and social rights, discrimination and affirmative action, issues of procedure and jurisdiction and issues such as the death penalty and the protection of refugees, minorities and victims of armed conflicts. At the universal level, the book introduces the reader to the labyrinth of United Nations Charter-based and treaty-based procedures. As well as an overview of the Inter-American and African systems, it deals at the regional level particularly with the case law of the European Court of Human Rights in Strasbourg, and also looks at the national level at the case law of the US Supreme Court and the South African Constitutional Court. This book adopts a particularly critical approach to the so-called dynamic" interpretation of the European Convention on Human Rights by the Court of Strasbourg. It is the author's feeling that judges in particular those belonging to courts specialising in human rights have a tendency to systematically support interpretations benefitting the applicants while overlooking too easily the far-reaching implications of judgments for society as a whole. He prefers a more balanced and more realistic approach taking into account the difficulties democratic governments face in coping with the challenges of our present time and with the pressing needs of the realities of today's world. Marc Bossuyt has not only a vast academic experience as Professor of International Law (at the University of Antwerp), as Visiting Professor in universities in Africa America and Asia and as a researcher in the field of International Human Rights Protection. He also has extensive administrative experience (as Commissioner General for Refugees and Stateless Persons) diplomatic experience (as Member and Chairperson of United Nations Commissions Committees and Conferences on Human Rights) and judicial experience (as a Judge and President of the Belgian Constitutional Court).
